Terms of Service

Starter terms covering how Fleet Tracker actually works today - not a substitute for advice from a lawyer. Review before relying on these for serious liability protection.

1. What this is

Fleet Tracker is a fleet, booking, staff, and maintenance management platform for asset-hire businesses (kayak hire, and similar), operated by Virtutis Digital. By creating an organization or accepting a staff invite, you agree to these terms.

2. Accounts and organizations

One email address belongs to exactly one organization - it can't be a staff member of two businesses at once on this platform. The person who creates an organization (via /signup) becomes its first Manager and can invite further staff, assign roles, and manage permissions.

3. Subscription and billing

New organizations get a 7-day free trial. A card is required upfront; once the trial ends, a flat $29.99/month (AUD) is charged automatically until you cancel. All payments are processed by Stripe - we never see or store your card details. See our Refund Policy for what happens after a charge. Cancel any time from the Billing page; access continues until the end of the period you've already paid for.

4. Your data, your customers

You (the organization) are responsible for the data you and your staff enter about your own business, fleet, and customers, and for having a lawful basis to collect it - including anything customers share through the QR check-in flow. We act as the platform processing that data on your behalf; see our Privacy Policy for how we handle it on our end.

5. Acceptable use

Don't use Fleet Tracker for anything unlawful, to store data you don't have the right to collect, or to attempt to disrupt or gain unauthorized access to the service. We may suspend or terminate accounts that breach this.

6. Availability

We aim to keep Fleet Tracker available and reliable, but this is a small operation without a formal uptime guarantee (SLA). We'll do our best to give notice of planned maintenance that affects access.

7. Limitation of liability

To the extent permitted by law, Fleet Tracker and Virtutis Digital aren't liable for indirect, incidental, or consequential loss arising from your use of the service. Nothing here limits liability that can't be excluded under Australian Consumer Law.

8. Termination

You can cancel your subscription at any time from the Billing page. We may suspend or terminate an organization's access for breach of these terms or non-payment, with notice where reasonably possible.

9. Changes to these terms

We may update these terms as the product changes. Material changes will be reflected here with an updated date; continued use after a change means you accept the update.

10. Governing law

These terms are governed by the laws of Australia.
